What is meant by collaborative law?

Collaborative Law is a new approach to divorce, child custody, and settlement of financial agreements. In the new collaborative law process, mediation is used to resolve disputes between couples without court involvement.

What is a prenuptial agreement in marriage?

A prenuptial agreement (or prenup) can be thought of as an agreement that is made before a couple is married. It details the financial and property arrangements for the spouses in the case of divorce.

What is a fair separation agreement?

A separation agreement is a legally binding document that both parties use to divide the marital assets, debts and other responsibilities. These documents are meant to ensure that each spouse will have a fair amount of separation from the other.

Can a family court decision be appealed?

If you’re in the middle of a legal battle, and the judge who made your interim decision was out of the country, or died before your case was over, you can take your case to the BC Court of Appeal. If your matter is heard under the Family Law Act, your only option is to appeal if the Court of Appeal says it’s okay to do so. This is called getting leave to appeal.
